Introduction

- Fllawi is an online broker platform that links tourism service providers with those wishing to benefit from those services which are provided by service providers via the platform, and the customer can access them through our website Fallawi.sa or any of the other channels provided by us such as a smart phones application or any other channel.

- Fllawi's team seeks to bring the best of tourism and entertainment products and services providers who meet our terms and conditions, and who provide their services according to the criteria and standards approved by us.

- In Fllawi platform, we seek to use the latest technologies in the platform to make your experience easy and smooth.

- We provide all our services to service providers, customers and all users of the platform according to the following terms and conditions:

Section 1: Definitions

The following terms and expressions shall have the meanings shown next to each of them unless the context otherwise requires:

"Fllawi" or "Platform" or "Website" or "We" or "Our" or "Us": refers to "Fllawi" website www.fllawi.sa and all its affiliated sub-websites from time to time whether any of what was mentioned registered on a public or local domain, as well as "Fllawi" application for smartphones and Professional Developer Organization for Advertising Services in Saudi Arabia, or any organization affiliated with, associated with, controlled, controlled by or completely or partially replace it in owning, running or utilizing the website or application.

"User", "you" or "the second person pronoun": refers to everyone who visits or uses the platform in any way, whether he\she is a service provider, customer, etc and whether he\she was registered with us on or just a visitor to the platform.

Service Provider” refers to every natural or legal person who uses the platform for the purposes of offering his\her services for booking and buying by customers or advertising them in any way through the platform, which includes but is not limited to services, trips, tourist and entertainment activities and other services that are offered for sale or rent by the service provider through the platform.

"Customer" refers to every natural or legal person who uses the platform for the purposes of benefiting from the services provided by service providers through Fllawi platform, and this includes everyone who contacted the service provider to enquire about those services and everyone who submitted their buying requests through the platform.

Services” refers to any of the services or products offered by "service providers" and available for sale or rent through the platform which includes but is not limited to services, trips, tourism and entertainment activities.

“Booking /buying” refers to the request submitted by the customer to book or buy one or more services provided by any of the service providers registered in the platform, after contacting the latter and agreeing with him\her on all the details of the service and its price.

Policies” refer to the policies issued by "Fllawi" platform regulating one or more aspects of the business or services provided by the website and the modifications that occur to any of those policies from time to time.

“Account” refers to the account that Fllawi allocates to its users, whether they are service providers or customers, for account purposes and enabling the mentioned user to use the features and services provided by the platform.

Intellectual Property Rights” refers to any intellectual property right (such as copyrights, trademarks, patent, industrial designs) established under the law of any country or the provisions of any international agreement.

“Data of the offer” refers to the data and information provided by the service provider regarding him\herself and/or his\her facility or business or regarding the services he\she provides or advertises through Fllawi platform, which includes but is not limited to (name, address, contact details, and service type and the place where it is provided, the times when it is provided, the mechanism of its implementation and delivery, its prices, all its features and characteristics, the trademark of the service provider, and other data that make the customer identifies the service provider).

“Platform Review” the review given by the platform to the service provider according to the bases, standards and review policy set by the platform for this purpose.

“Customer Review” refers to the review that the customer adds to the service provider after carrying out the services, which contains the customer's comment and opinion.

Agreement” refers to this document with its terms and conditions, as well as all the policies that Fllawi provides through the platform, whether they are general policies for all our services or specific policies for certain services, besides any special agreements made between the platform on the one hand and any of its users on the other hand, including all contracts signed now or in the future regarding regulating the use of any of the platform's services.

 

Section 2: Legal scope of our service 

(1) All users know and agree that Fllawi is nothing but a link that links tourism and entertainment products and services providers with customers wishing to benefit from them. Thus, Fllawi is not responsible for running or providing the service itself and does not control how it is provided or its prices in any way, the services are provided completely by service providers and our role is limited to making the platform available technically.

(2) You know and agree that Fllawi platform is not a service provider or customer with the meanings referred to in Section "1" of this policy, and the platform does not provide any of the services of service providers nor does it demand any of those services for itself, and the platform does not represent either party, Fllawi platform is not an agent for the service provider or the customer, as each person represents himself via the platform.

(3) Fllawi platform is not an informational content provider, since the content available through the platform is specific for service providers, and the service provider is fully legally responsible for this content and is a publisher of this content legally.

(4) Any content provided by Fllawi platform is dedicated to viewing information, advertising and media purposes, and the platform does not provide any guarantees regarding relying on this content, and the user must check it completely to make sure that it is of good quality, accurate and new.

(5) You expressly relieve the platform from any small or serious mistakes, intentional or unintentional, made by service providers, customers or any users of the platform.

(6) Fllawi seeks to raise the quality of services provided by service providers via the platform by reviewing the added services before posting them on the platform and checking that they are legal and provided according to the mentioned description, but this does not mean providing any guarantees by the platform regarding the quality of services and how much the service provider is committed to the description and the data of the offer which is available through the platform, our role is limited to administrative supervision via the platform and not technical supervision on providing services.

Section 3: Capacity to join the agreement

(1) The user must have reached 18 years or more to enter into this agreement with us, and the user must also have full legal capacity and not be interdicted, foolish, feeble-minded, insane or any other reason that makes the person incapacitated.

(2) If the user is less than 18, he/she must join this agreement through and with the consent of his\her parent or guardian.

(3) Fllawi platform reserves the right to cancel the membership of any user or block his\her access to the platform if we discover that he\she is not fully capacitated.

Section 4: Acceptance

(1) Having anyone on the website, using any of the benefits, services or features the website provide, or opening an account on the website is an acceptance of these terms and conditions and all "policies", it is also a declaration by that one to the platform and all the users that he\she meets the conditions that must be available in the "user".

(2) Your use of the platform or your sign up with us acts as an electronic signature to this agreement replaces your handwritten signature on it, and you are not allowed to release from its obligations resulting from this acceptance.

Section 5: General terms of signing up an account with the platform

(1) The user (customer, service provider) must sign up with only one account with us, and he shall not sign up with more than one account without obtaining our consent, and if the user’s account is deleted for any reason, he/she must obtain our consent before signing up a new account with us.

(2) The user (customer, service provider) must give correct, accurate, updated and regular information when signing up, and if the information is proven to be incorrect, Fllawi has the right not to activate the user's account, or cancel the account at any time.

(3) The user (customer, service provider) undertakes not to create any fake accounts or use fake names other than the approved given or business name.

(4) The user (customer, service provider) undertakes not to give false, incomplete or misleading data for any purpose or reason, including his/her identifying or contact details.

(5) Fllawi has the right to ask for any identification documents from the user (customer, service provider) to make sure that his/her data and identity is true.

(6) The user declares that he/she knows that the "account" given to him on the website is based on personal consideration, and can only be used by the user himself/herself  or by one of those authorized to use it, and it cannot be transferred (sold) or rented to others, and the user declares that he/she is directly and legally responsible for everything published on the website, and all actions and correspondence that take place through his/her account.

(7) The user (customer, service provider) authorizes the website to inquire about the validity of his personal data such as (name, national identity number, contact details, bank account number) or inquire about the validity of his business data such as (company/organization name, commercial registration, registration status) from the official or private authorities concerned with releasing or keeping this data. This Article does not make the platform legally obliged to inquire about all users registered with us. In all cases, the platform does not provide any guarantees that the account owner is the person he claims to be.

(8) Fllawi has the right to delete any user (customer, service provider) without prior notice for any reason that Fllawi deems worthy of deletion, without having to mention the reasons for deleting the user's membership.

(9) Fllawi has the right to sue any user (customer, service provider) who uses the website for illegal or immoral purposes.

Section 6: General terms of verifying an account with the platform

(1) Fllawi has the right to ask for any documents that may support this request as it deems appropriate, and it has the right to deny the verification if these documents are not provided.

(2) Fllawi has the right to deny the account verification without any reason.

(3) Verifying an account means verifying the data and documents provided to us by the user (customer, service provider) and we verify these data and documents with ordinary diligence, and therefore the platform is not responsible if these data are false, doesn’t match or fake. In all cases, Fllawi platform will not be an information verifier.

(4) The verification of an account on Fllawi platform does not give the user any approval by the platform, and the verification is not a guarantee about the services provided by the service provider, their quality or legality, nor it is a guarantee about the customer and how much he/she is serious about ordering services.

Section 7: Customer's Terms and Conditions

(1) Customer's Account Registration Terms

1. The customer acknowledges that he/she is 18 years and older, and that he/she is in his/her full capacity when using and registering on the website and that he/she is not interdicted, commercially or debit incapacitated for any reason such as bankruptcy or insolvency, and that he/she is legally and statutory capacitated to conclude sales contracts and undertakes to fulfil all his/her obligations established under the contracts in which he/she is a party of.

2. The user must provide us with account registration data, which includes, but is not limited to (name, email, mobile number, country) and any other data required in the registration form.

(2) Customer's Account Verification Terms

To gain the trust of the service provider, it is better to verify your account, as the platform allows you to upload the verification request through your account and upload the necessary documents such as identity card or passport to request for verification, and the request is approved after being reviewed by Fllawi's administration.

(3) Terms of use the services

1. The customer knows and agrees that Fllawi does not provide any of the services viewed on the platform, but it is a bridge between service providers and those wishing to use them.

3. The customer must read all service information, terms of use, booking and cancellation terms before completing the payment process, and the website will not be responsible for the customer's misunderstanding or choice in any way.

4. The customer has the right to enjoy the service according to the mentioned description and the chosen time and to report any manipulation or fraud if any, and the platform will check if the report is true and take the appropriate action.

5. The customer has the right to seek clarification from the service provider about any unclear, not understood or ambiguous term or description so that the customer is well informed about all the terms of contracting.

6. The customer must see the policies of service providers, and respect these policies and all instructions of the service provider, and he/she must follow the applicable rules and regulations in his/her country, as well as any guidelines or instructions are shown in the service or that the service provider shall communicate them to the customer orally or in writing before contracting for the service.

7. The customer is responsible for the guests added to the booking by him/her "if any", and therefore he/she is fully responsible for all their own actions and for any damages they cause to the service providers or the platform, and he\she shall compensate any affected for any illegal actions committed by them

8. The customer must keep the place, utilities, or tools used in the same condition they were in when they have been picked up, and if the service provider reports any damages resulting from the customer or those accompanying him/her, in this case, the customer afford the cost of repairing the damage or replace what was destroyed with another one like or better than it, and if the costs are not paid, both the service provider or Fllawi have the right to file a lawsuit to claim those costs or other damages resulting from the delay in implementation.

9. The customer shall afford any fines resulting from causing any damages that the customer or those accompanying him/her may cause to the service provider.

10. The customer undertakes to keep his/her valuables and properties, and if they are lost, he/she has no right to claim any compensation from Fllawi or from the service provider.

11. The customer is responsible for any arrangements he/she directly makes with the service provider and which are done outside the platform, and the customer knows and agrees that the platform will not document such arrangements in the service order via the platform unless they are added and confirmed by both parties in the service order.

12. The customer shall abide by all applicable rules and regulations, he/she shall also respect the entered places and all the instructions organizing entering or staying in those places, including any inspections, bags delivery, etc.

(4) Insurance and Pricing Policy

1. The customer knows and agrees that all the prices for the offered services have been set by the service provider and that Fllawi has no right to set the prices of the offered services, and the service provider is ultimately responsible for these prices and shall update them if there are any changes to them, and he is also committed to the prices stated when the customer places the booking order.

2. The customer has the right to use the services according to the price viewed during booking or ordering and has the right to file a report if the service provider changed the price that is not viewed and by which the booking or ordering has been made.

3. The website automatically shows the lowest price for the service, and the price may vary on some dates from the price viewed in the front page or in the search results depending on the specified date, and the price available on the service page will be approved.

4. The service provider has the right to ask for money guarantees or insurances before starting to carry out the service while preserving the right for the customer to refund this money once the service is completed, and the service provider or Fllawi also has the right to deduct any fines due on the customer for any reasons related to violating the terms of use of the service or causing damage to any of the utilities, machines or tools accompanying the delivery of this service.

(5) Booking Policy

1. Before the customer books any service, he/she should read all its details, terms and prices, and make sure that it is available at the time of placing the order.

2. The customer should pay attention to the additional fees and prices associated with booking any "service", such as service or tax fees or any value added to the service or the additional services added to it.

3. When the customer books the service, this does not mean that the booking is confirmed, even if the payment process has been successfully completed through Fllawi, only after the service provider confirms the booking.

4. The service provider must confirm all bookings related to his service within 12 hours maximum from the time of booking unless there are reasons out of his control that lead to cancelling the booking along with mentioning the reason.

5. All the processes that are made on service bookings are communicated to all parties through the official communication channels registered by them on the platform. These addresses are valid and correct, whether they are phone or online communication channels.

6. The platform charges fees on the booking process called "booking fees", and the platform has the right to change the booking fees at any time without notice.

7. Cancellation and refund are subject to the cancellation and refund policy contained in the Terms and Conditions document (Section 9).

 

(6) Payment Policy

1. The platform provides the customer with multiple payment methods, so the customer can pay through bank transfer or other payment options provided by the payment gateway.

2. The customer’s payment for the booking order or the service does not mean that the booking is confirmed only after the order has been accepted and confirmed by the service provider or by the platform administration.

3. All customer payment information is not stored or saved in the website files or in payment gateway files.

4. The platform does not legally responsible if the customer is suffered from hackers or illegal acts on the payment accounts he/she uses, and the customer must adequately secure the payments and devices he\she uses, and the platform does not legally responsible if there is an error in the payment process, so the customer must review all payment information before confirming the payment process.

5. The customer knows and agrees that Fllawi platform has the right to change or update the payment policy at any time. The platform also has the right to change all or some of the payment methods available through the platform, and some payment methods may be available to some users and not available to other users for various reasons.

(7) Customer Reviews Policy

1. The customer has the right to review the service provider on each service he/she uses through the platform, and the review is done only once for each service.

2. The customer’s review must be objective and service-related, so it is allowed for the customer to write any comments without using any immoral, indecent, violating Islamic law or anti-custom words, and without insulting or offending any of the parties

3. Customer reviews are placed after being checked by the platform's administration, and these reviews remain on the service provider’s page and are not removed, so the service provider must make sure to get the best reviews from his customers, and the customer's review must reflect the service in order not cause customers to turn away from the service provider.

4. The customer undertakes not to misuse or try to mislead "the customer's review" system and the rating procedures provided by the platform, or to play with or affect it in any way, including providing inaccurate data or intentionally voting many times for one or more accounts or users, positively or negatively.

5. The customer shall not offend any other services of other service providers, or make comparisons that would offend the services of our platform or any other websites or applications, make any comparisons that would offend the services of our registered service providers and other service providers.

6. The customer shall not use the review service for the purposes of posting promotional content or posting contact details for any reason.

7. In all cases, the customer is fully responsible for any damages caused by the review he\she added through the platform, and the affected has the right to file legal claims against the customer and obtain appropriate compensation.

8. In all cases, Fllawi platform has the right to delete any review that we see that it is not consistent with any of our terms and conditions, or goes against the applicable laws.

Section 8: Terms and Conditions of the Service Provider

(1) Service provider's Account Registration Terms

1. The service provider acknowledges that he is carrying out his business according to the applicable regulations and that he has all the full authority and official documents that make him eligible to register with us on the platform and carry out his business online through us, and the legal representative of the business entity must register on behalf of this entity, in accordance with its official documents.

2. The legal representative of the service provider acknowledges that he has the full legal capacity when using and registering on the website and that he is not interdicted or lacking commercial or debet capacity for any reason such as bankruptcy or insolvency, and that he has the legal and statutory capacity to conclude sales contracts and undertakes to implement all his obligations established under the contracts where he is a party of.

3. The service provider must provide us with membership registration data, including, but not limited to (the name of the organization/company, commercial registration, release and validity date of the commercial registration, address, email, mobile number, phone number of the business "if any"

(2) The service provider's Account Verification Terms

1. To gain the trust of customers, it is better to verify your account, as the platform allows you to upload the verification request through your account and upload the necessary documents such as the commercial registration, ID card and trademark certificate for the verification request, and the request shall be approved after being reviewed by Fllawi's administration .

2. If the account is verified, the verification icon will appear active next to your commercial name.

(3) Terms of Providing Services

1. By registering as an individual service provider or a business, you undertake that you are authorized to provide the services added by you on the platform in the country in which they are provided and that they do not go against local and international laws.

2. Since you are a service provider, the platform allows you to add and control your services and manage your bookings in terms of confirmation and cancellation.

3. If you register as a service provider, you know very well that your relationship with Fllawi is a limited relationship since you are an independent member and not an employee, shareholder or a partner with Fllawi, and that you provide your services for your own interest and not for Fllawi's interest.

4. When you enter the services, you undertake that the offering data and all information is clear, correct and accurate, and describe the service in a way that is free from ambiguity or vagueness, and you acknowledge that the information and description completely match the services you provide.

5. The service provider shall not add any services that do not agree with Islamic law, Arab culture, laws or regulations applicable (including agricultural, animal or health regulations) in any country, the service provider shall also not offer services whose circulation or trade is banned for any reason, and if any of the applicable laws or regulations require obtaining a permit or special approval to trade or deal in a service, the service provider must obtain all the required approvals before adding those services, and the service provider's offering of the services is a declaration by him that he had obtained all the necessary approvals and permissions

6. When you add any service, the platform administration will revise it and check the validity of the entered data, and then confirm it to appear in the search results.

7. The service provider is not allowed to disagree with any of the recommendations contained in the "website", the order of results when searching, the "platform review" given by the website to service providers, offered services, or other categories, and he is also not allowed to disagree with- or request to delete - any of the comments or opinions expressed by any other users of the website in any way.

8. The service provider has the right to set additional requirements that must be met in the customer, such as bringing the original or sending a copy of ID, passport, age, etc. to get the service or product, and the service provider has the right not to provide his services to the accompanying persons who do not meet these requirements.

9. The service provider acknowledges and guarantees that he owns any visual, audio or text content used in his services, or that he has the right to use this content with proof of that and that he is fully responsible if that content is illegal, unlicensed, or violates any right of others such as privacy rights, intellectual property rights, commercial rights or any other rights of others.

10. The service provider shall not take photos of the customer or publish the photos that he took only after obtaining the express consent of the customer, whether to take photos or publish them through us or through any other means.

11. The service provider shall carry out the services according to the description advertised through Fllawi, and if the service provider violates any of the advertised programs on the basis of which the customer placed the booking order , in this case the service provider shall compensate the customer with as much as what is lacking from the service.

12. If the customer booked with the service provider and the service provider did not fully carry out the services, in this case he shall compensate the customer for all the damages as a result of not carrying out the service.

13. If the service provider is unable to carry out the agreed services, then he can let the customer to choose between (provide another service provider with the same terms and specifications and in this case, Fllawi must agree, or canceling the service order), while the customer retaining the right to claim any damages caused to him\her as a result of canceling the service in an inappropriate time.

14. If the service provider is late to carry out the services for the customer according to the agreed dates, in this case the customer has the right to cancel or continue in the service, and if the service is canceled by the customer, he\she reserves its right for compensation, and if customer chooses to continue in the service, in this case the service provider must carry out the service in full.

(4) Pricing and insurance policy

1. The service provider acknowledges that the published prices for the services are final, and there are no additional amounts or fees not included except for any additional services that the customer adds on the same service.

2. The service provider has no right to change the value of the booking other than the value with which the booking was made through the platform.

3. The service provider is ultimately responsible for updating the prices to avoid any problems with those who accompany, and accordingly, he compensates the affected with what Fllawi deems appropriate.

4. The website shows the lowest price for the service automatically, and the price may differ on some dates from the price displayed in the interface or in the search results according to the specified date, and the price available on the service page will be approved.

5. The service provider has the right to ask for financial guarantees or insurances before starting to carry out the service, while retaining the right to the customer to refund these amounts immediately after the end of the service. The service provider or Fllawi has the right to discount any financial fines due on the customer for any reasons related to violating the terms of using the service or causing damage to any of the facilities, machines or tools accompany with providing this service.

(5) Booking Policy

1. The service provider knows and agrees that the services added by him via the platform are available for booking by the customer. And the provision of the service acts as making it available for Online booking through the platform, and the service provider undertakes to update the booking status and turn it into unavailable if the services are not available for booking at any time.

2. The service provider undertakes to follow up on the bookings on the platform and take the necessary action in terms of confirmation or cancellation.

3. When the customer books the service, this does not mean that the booking is confirmed, even if the payment has been successfully completed through Fllawi, only after the booking has been confirmed by the service provider.

4. The service provider must confirm all bookings related to his service within 12 hours maximum from the time of booking unless there are reasons beyond his control that lead to cancelling the booking, along with mentioning the reason.

5. If the service provider cancels the bookings without any convincing reasons, he shall bear any appropriate compensations as deemed appropriate by Fllawi management for all parties.

6. If the booking is confirmed by the service provider, he undertakes to provide the service or product to the customer according to the description and terms mentioned, and if he violates any of the terms, the customer or Fllawi has the right to claim any financial or non-financial compensations as it deems appropriate by Fllawi for both parties, and if no solution is found, the customer or Fllawi has the right to file a complaint with the competent authorities to settle any issues, and this is what Fllawi management does not look forward to.

7. When the service provider confirms the customer's booking, it means that the customer trusts the service provider's ability to provide the booked services as the mentioned description and that the service provider's violation of any of the service's features, the way it is provided, the dates or the agreed terms may cause damage to the customer. And Fllawi has the right to claim compensation for the customer as it deems appropriate.

8. All transactions made on service bookings are communicated to all parties through the official communication channels registered by them on the platform, and these addresses are valid and correct whether they are telephone or electronic channels of communication.

9. The platform charges a fee for the booking called "the booking fee" and the platform has the right to change the booking fee at any time without prior notice.

10. Cancellation and refund are subject to the cancellation and refund policy contained in the Terms and Conditions document (Section 9).

 

(6) Payment Policy

1. The service provider knows and agrees that all payments of his services are made through the payment gateway of the platform which contains many payment options, and thus the service provider authorizes Fllawi to receive the value of the service or the product from the customer.

2. The customer's payment for the booking request or service does not mean the booking is confirmed until after the request has been accepted and confirmed by the service provider or by the platform's administration.

3. Once the customer pays through the platform, the service provider shall implement the agreed services in accordance with the agreed description and prices, and he has no right to claim the customer any additional payments not previously agreed upon.

(7) Service provider's dues collection policy

1. The service provider can file a collection request of the amounts due and which have been paid by customers through the platform’s payment gateway in return for obtaining these services after the booking ends.

2. The amounts are transferred to the service provider's account created by him in his dashboard, and the collection of the amounts is within three business days maximum from the date of booking, and some delays may occur for the purposes of implementing any of our terms and conditions and for the period necessary for that.

3. The service provider must provide us with valid payment data of him, bear the consequences of any delays arising from not sending the payment data to the platform, and shall bear all consequences arising from the error in the payment data.

4. The platform's commission agreed and shown in the service provider's account shall be discounted, and the receiving of the amounts by the service provider is a final settlement of the amounts due to him that cannot be challenged before any other party.

5. Fllawi has the right to set the minimum amount for filing the financial claim and has the right to change this amount, whether by increasing or decreasing at any time and without any prior warning and without giving any reasons.

(8) Safety Commitment

1. The service provider undertakes to maintain the safety of customers and those accompanying them and acknowledges that the services he provides do not constitute any danger to them and bear any consequences if one of the customers or those accompanying them suffers any injuries or any physical, psychological or financial damages, and this includes assuming all criminal liabilities or compensation established or awarded.

2. The service provider undertakes not to provide any harmful, banned substances, or against Islamic law, local and international commercial laws.

3. The service provider undertakes to respect all customers and those accompanying them, treat them at the same level and do his best to provide the services as fully as possible.

4. In all cases, the platform will not be completely, partially, originally, subsidiary or jointly responsible for any damages caused to the customer or those accompanying him/her during or due to the delivery of services.

Section 9: Cancellation and Refund Policy

1. The service provider sets his own cancellation and refund policy in a way that is clear and not misleading to customers, and announces that policy on every service page, and the service provider shall make this policy consistent with the applicable regulations.

2. If the customer and the service provider agree to implement a service without agreeing on its cancellation or refund policy, then in this case the applicable laws regarding e-commerce regulation and consumer protection will be applied.

3. Refund for customer reasons:

- The customer affords the transfer fees to his\her account if the refund is for reasons due to the customer, with the application of the cancellation and refund policy of the flight.

- Customers will be fully refunded if the cancellation is related to weather conditions that prevent the flight from being carried out.

- In all cases, the customer will be refunded within 15 business days maximum from the date of accepting the refund request, cancel the booking or any other period required to process the payments, and the customer has the choice between adding the amounts to his\her e- wallet on the platform immediately or requesting a refund of the amount on the same payment method used in paying the amount.

- If the customer chooses for the amounts to be refunded to his\her e-wallet on the platform, he\she has no right to request to refund them to any payment method again.

- All amounts in the wallet are valid for use to purchase services on the platform for six months from the date of adding them to the wallet, after that the balance that has lasted for more than six months without use will be deleted.

4. Refund for reasons due to the service provider:

- If the cancellation of the order is due to the service provider, he shall afford the refund fees, such as transferring from the payment gateway or transferring to the customer’s account along with discounting the booking fees from him.

- The service provider must return the customers' refunds to the platform’s account within seven days from the cancellation date.

5. In all cases, whether the refund is by the customer or by the service provider, the booking fee is not refundable.

6. In all cases, the platform does not afford any transfer fees to get customer payments back from the service provider.

7. Some activities depend on weather conditions, and if the order is canceled due to bad weather on the same day the service is delivered or after arriving at the location of service delivery, the refund includes the price of the programs that have not been implemented only, while the programs that have been implemented, they will not be covered by the refund, as not to harm the service providers.

8. The platform has the right to discount the customers’ dues from the service provider’s balance if he has any dues on the platform.

Section 10: Confidentiality of information

(1) All users' data(including the service provider), services offered or completed sales data, and other data and comments that appear on the "website" or via or about any "account" are owned by the platform (such as offer data, contact details "phone numbers - email- Facebook accounts- etc.", addresses, prices, name, commercial registration, registration status, national identity number, contact details, bank account number, etc.) [All what is mentioned is referred to as "data"], and the platform is free to handle on this data for the purposes of providing, marketing or promoting our services, and we may also provide others with all or some of this data for purposes of assistance in providing our services, and entering into this agreement with us is considered as an express consent of handling your data..

(2) The user declares that he\she knows that the "website" is not responsible for the data or information contained in the pages and websites to which this "website" refers and that what is mentioned is not subject to its control, guarantee or warranty, as all of what was mentioned is the responsibility of the owner or creator of those pages or websites.

(3) The user shall maintain the confidentiality of the platform’s information and all the dealings that take place through it, and any user shall not use any data that the platform is a party to for the purposes of causing harm to us or our services or disclosing its confidentiality.

(4) Fllawi shares with the service provider some of the customer information required such as the name, e-mail and contact number for the purpose of making reservations, and the service provider undertakes not to share this information with any other party for any reason and undertakes to maintain the privacy and confidentiality of customer information and not to use it for any personal or commercial purposes, and in the case where that is proven, Fllawi has the right to take legal actions in case the service provider violates the provisions of this paragraph.

Section 11: Correspondences

(1) All correspondences and notices that the platform sends to any user at the address specified by the user or the e-mail specified by the user or via the messaging feature provided by open accounts via the "platform" or text messages, shall be valid and the delinquent party shall bear the liabilities. The user shall be deemed to have received and seen these correspondences as soon as they were sent.

(2) Any message or correspondence sent to the platform through e-mail or to an address other than the specified address shall be null and have no liabilities even if the platform has confirmed that they are received and been replied to.

Section 12: Intellectual property rights

(1) The platform with its website and a smartphones application it contains, all their elements and ideas expressed within them are intellectual property rights of Fllawi platform, and this includes all (software, texts, images, videos, graphics, information, data, databases, tables, lists of services, prices, the content of the services, symbols, numbers, letters, etc), and Fllawi platform has the right to defend its intellectual property rights before all parties if they are infringed in any way.

(2) "Fllawi" and all other service marks are our trademarks and service marks, and you have no right to imitate, copy, modify, or use them in any traditional or digital means without obtaining our consent, and if any of our trademarks or service marks are infringed, the platform reserves the right to defend its rights over trademarks and service marks before all competent authorities.

Section 13: Disclaimer

(1) We provide the platform services as available without providing any guarantees of any kind regarding the platform services or the content available through them, and you accept our services as they are.

(2) Our services are Internet-based, and therefore we do not guarantee that our services will fully work 24 hours, services may be interrupted from time to time, and in spite of taking all safety standards, online services, in general, are at risk of hacking and other illegal operations, you, therefore, release us from any liability arising therefrom.

(3) The platform disclaims its legal responsibility for any damages caused to the customer during or due to carrying out the services by the service provider, and the platform does not provide any kind of insurance or compensation to the customer for any damages caused to him\her or those who accompany.

(4) The platform disclaims its legal responsibility for any damages caused to the service provider due to any illegal acts or behaviors carried out by the customer or those accompanying him\her, and the platform does not provide any kind of insurance or compensation to the service provider, his followers or his assistants.

Section 14: Sanctions

(1) The platform has the right to terminate this agreement if the service provider does not comply with the terms of this agreement, the services are not provided as agreed, or if the results required from this agreement are not achieved.

(2) The platform has the right to impose various sanctions on the service provider if he violates any of the terms and conditions of this agreement, including but not limited to (temporarily or permanently suspending membership, partial or total discounting of the service value, compensation with double the value of the service.

(3) The service provider shall compensate the platform if the services are not carried out as agreed, carried out wrongly, delayed, or caused to miss any opportunity for the platform or customers, and the compensation must not be less than double the value of the service.

(4) The service provider shall compensate the platform in case of defaming, offending Fllawi in any way or using its name in a way that violates the agreement or the law, or in any way that offends or causes it to have legal disputes.

(5) The service provider is legally responsible for compensating the customer with the appropriate compensations if the customer suffers any damage as a result of the service provider’s fault or negligence in providing services or his violation of any of the terms and conditions of this agreement or infringement of any of the customer’s personal rights.

(6) In all cases, the platform has the right to resort to the judge/court to claim all compensation related to the damages caused by the service provider, while the service provider affords the judicial costs and attorney fees.

Section 15: Legal competence and competent courts

The interpretation and implementation of this agreement are governed by the regulations applicable in Saudi Arabia, and the Saudi courts are competent to any dispute arising from the interpretation or implementation of any of the terms and conditions of this agreement.
